Successful resolution of dispute between housebuilder and new homeowners

We acted for a well-known national house builder who was experiencing difficulty in recovering rent charges on one of its residential housing developments. As is often the case with such developments, our client operated a rent charge scheme whereby the individual home owners contributed to a central fund paid to the house builder for the maintenance and up-keep of the development's communal parts. Our client was having difficulty recovering the rent charges due. Although on an individual basis, the amounts in question were relatively minimal, something had to be done. The important factor for our client was to establish the principle that they were entitled to charge these sums, whilst not damaging their reputation in the process. Legal proceedings were issued against the residents and we secured an order in our client's favour. We succeeded in managing the case sensitively to ensure that the client's point of principle was maintained, without damaging their reputation.
