Defence of client in Health and Safety breach: R -v- Sub Surface Engineering Limited

The General Manager of a marine company was prosecuted after an incident which left a trainee employee with a fractured ankle.

The company and two senior managers were originally investigated but our representation persuaded the HSE to discontinue the prosecution of the company and one manager.

We continued the defence of the General Manager who was driving a fork lift truck carrying sheet metal which fell from the truck injuring the trainee. He was charged with a health and safety breach as the load had not been properly secured. He was fined £2,500 and ordered to pay costs of £1,000.
