Company guilty of "serious culpable oversight" in fatal Health and Safety case: R -v- Biffa Waste Services

Biffa Waste Services was fined £190,000 and ordered to pay compensation of £10,000 and £50,000 towards prosecution costs, following the death of a non-employee totter who was hit by a reversing shovel loader.

The HSE prosecution found that no specific risk assessment had been carried out pertaining to the deceased's role and the company was found guilty of a "serious culpable oversight".
